People searching for the best betting sites in Kenya without tax are usually looking for something that does not exist among licensed operators. Kenyan law charges excise duty when you deposit into a betting account and withholding tax on winnings, and every licensed bookmaker must apply both. This guide explains how each tax works, how to see it on your deposit screen and bet slip, why "no tax" offers need a careful read and what changed in 2025 and 2026.
The two taxes on betting in Kenya
| Tax | When it is charged | Who deducts it | Where you see it |
|---|---|---|---|
| Excise duty | When you deposit into your betting wallet | The operator, automatically | Deposit confirmation and wallet balance |
| Withholding tax | On winnings, before payout | The operator, automatically | Bet slip tax line and settled ticket |
We do not print the rates here because they have changed several times and are set by Finance Acts. Check the current rate on your bet slip, the operator's tax note or KRA guidance.

How excise duty on deposits works
Since the Finance Act 2025 took effect in July 2025, excise duty is charged on the amount you deposit into a betting wallet rather than on each stake. In practice:
- You send money by M-Pesa paybill, STK push or Airtel Money.
- The operator calculates the excise on that deposit.
- Your wallet is credited with the deposit minus the excise.
That is why the balance in your account can be lower than the amount that left your M-Pesa. The deduction is not a fee the bookmaker keeps; it is collected for the tax authority. Many operators explain this on the deposit page.
How withholding tax on winnings works
Withholding tax is deducted from winnings before the money reaches your wallet. The Finance Act 2025 briefly replaced the tax on winnings with a tax on withdrawals, and the Finance Act 2026 reinstated withholding tax on winnings from July 2026. Reports differ on whether a withdrawal tax also remains, so check the operator's withdrawal screen for any deduction there.
On the bet slip, a typical display shows the gross potential win, a tax line and the net amount. If you place a KES 100 slip at total odds of 10.00, the gross return is KES 1,000; the net payout is that figure minus the withholding tax shown on your slip.
Are there betting sites in Kenya without tax?
Not among licensed operators. Kenyan tax rules apply to every licensed bookmaker serving Kenyan customers, so a "betting site with no tax in Kenya" usually means one of three things:
- A promotion. Some operators run offers that top up or refund part of the tax on certain bets. That is a bonus under the operator's terms, not a tax exemption. Read the conditions.
- An unlicensed offshore site. Sites operating without a Kenyan licence may not deduct Kenyan tax, but you lose the protection of local regulation: no Kenyan regulator to complain to if winnings are withheld, and payment channels that regulators have shut down before.
- A misleading advert. Claims that a site is "tax free" can be marketing that falls apart once you read the terms.
Our advice is to stay with operators that show a current licence. Our list of licensed betting sites is the starting point, and the regulator is now the Gambling Regulatory Authority (GRA), which took over from the BCLB under the Gambling Control Act, 2025.
What changed in 2025 and 2026
- July 2025. Excise moved from stakes to deposits, and the tax on winnings was replaced by a tax on withdrawals.
- July 2026. Withholding tax on winnings was reinstated, with operators deducting it before paying winners. Excise on deposits continues to apply.
Because the rules moved twice in two years, older guides and forum posts are often wrong. Trust what your operator's screens show today.
How tax changes the way you bet
- Deposit less often. Excise applies each time you deposit, so frequent small top-ups do not save tax, but they do make it harder to track how much you have spent.
- Small edges disappear. Arbitrage and very low-margin strategies rarely survive tax; see our betting strategy guide.
- Read the net figure. Judge a bet by what it would pay after tax, not by the headline return. Our bet slip guide shows where the net figure appears.
Do you need to declare betting winnings yourself?
Withholding tax is collected at source by the operator, which is why it is deducted before payout. If you have questions about your own tax position, for example large winnings or business income, check KRA guidance or speak to a tax adviser. This guide is general information, not tax advice. Our other guides for Kenyan punters cover slips, markets and strategy.
Betting is for adults 18+ only. Taxes make the house edge larger, which is one more reason to keep betting to a small, fixed budget.

Frequently asked questions
Is there any betting site in Kenya with no tax?
Not among licensed operators. Excise on money paid in and withholding tax on money won apply to all of them. Sites claiming to be tax free are usually running a promotion or operating without a Kenyan licence.
Why is my betting balance lower than my M-Pesa deposit?
Excise duty is deducted when you deposit, so the wallet is credited with the deposit minus the tax. The deposit confirmation usually shows the deduction.
Is withholding tax charged on my stake or on my winnings?
Under the rules in force from July 2026 it is deducted from winnings before payout. Check the tax line on your bet slip for the amount.
Where can I find the current betting tax rates?
On your operator's deposit and bet slip screens and in KRA guidance. Rates are set by Finance Acts and have changed several times.
Can I get a refund of betting tax?
Tax deducted at source is generally not refunded by the operator. Some promotions top up part of the tax under their own terms; read them before you rely on that.
